General Terms and Conditions of Sale

1. Purpose and Scope of Application:
Any order for work implies the client's acceptance of these general conditions of execution and payment. The quote and its amendments constitute the specific conditions of the work to be carried out. The contract is subject to French law. The parties may seek an amicable solution to any disputes that may arise during the performance of the contract.
2. Duration and Validity of the Offer:
The company's offer is valid for 2 months.
If the client makes modifications before acceptance, the company reserves the right to refuse them or to propose a new offer.
3. Client Information:
Your telephone details: in accordance with Article L.121-34 of the French Consumer Code, we inform you that you have the right to register on a list to opt out of telephone solicitation.
All your contact details, of any kind, collected by us are used solely to process your request and are recorded in our customer database. These data are exclusively intended for our company.
4. Authorizations:
The contract is concluded under the suspensive condition of obtaining:
within 3 months, the administrative authorizations;
within 1 month, the neighbor authorizations.
The client is responsible for obtaining these authorizations and must provide formal proof to the company.
To prepare an accurate quote and ensure the smooth progress of the worksite, the client agrees to provide the company with a copy of all plans and information in their possession regarding the work to be carried out.
5. Work Execution Conditions:
The work will be carried out in accordance with current regulations and professional standards.
The company reserves the right to refuse the use of materials or products supplied by the client.
If the base reveals unforeseen constraints, undetectable before the work begins, an amendment will be drawn up to specify the additional work and its cost.
Regarding so-called "aesthetic" materials (tiles, paving, gravel, etc.), the company, after presenting samples or technical sheets, may request written approval from the client for the material selection.
6. Execution Deadline and Delivery Date:
The work will be executed within the time specified in the quote. This deadline may be extended in case of amendments, delays attributable to the client, force majeure, bad weather, or material stock shortages.
These same causes may result in a delay in the project delivery date.
7. Contract Modifications:
Any modification to the contract will result in a priced amendment agreed upon between the company and the client.
8. Price:
The price is determined by the quote, potentially modified by amendment.
Prices are based on the VAT rates in effect at the time of the offer. Any change in the VAT rate will be reflected in the final price including tax.
9. Payment:
A deposit of 30% must be paid after the legal withdrawal period.
If the contract is concluded off-premises, the client has a 14-day withdrawal period. After this period, if the right of withdrawal is not exercised, the 30% deposit becomes due.
The company may postpone the start of the worksite until the deposit is received.
Depending on the nature and cost of the work, staged payments may be required.
Any delay in payment, whether of the deposit or an interim payment, will result in work suspension and an extension of the execution deadlines.
The final invoice is payable:
upon project completion, if the acceptance report has no reservations;
once any listed reservations are resolved.
Payment terms are always specified in the quote.
10. Use of a Loan:
If a loan is used to finance all or part of the work, the client must inform the company.
If the contract is concluded under the conditions provided by the French Consumer Code, specific information will be attached to the contract.
Consumer credit (Articles L.311-1 and following): the client must inform the company in writing, within 7 days after the 14-day withdrawal period, whether the loan is granted or refused.
Real estate credit (Articles L.312-1 and following): if the client has indicated their intention to use a mortgage loan, the contract is concluded under the suspensive condition of obtaining the loan within a period agreed with the company (minimum 1 month from the request). The client must inform the company in writing of the final decision within 7 days of the end of this period.
11. Work Acceptance:
The acceptance of the work, with or without reservations, is carried out in the presence of the client and the contractor. It results in a report signed by both parties, each keeping a copy.
12. Contract Termination:
In the event of a breach of contractual obligations by either party, the contract may be terminated by the other party, 5 days after a formal notice sent by registered letter with acknowledgment of receipt remains without effect. This termination may be accompanied by claims for damages.
